Sell Engagement Ring - Need a Woman's Perspective

Aye it sounds like it’s her ring now, sorry

but I wonder if what you really want is payment or some emotional closure to make how it ended feel less painful?

@Schizbro I didn’t say she stole the ring. I am planning to offer to sell the ring to her. I think I’m going to wait it out.

Yeah, but if she she has any ethical moral, she would return the right, right? I am just so confused right now that I do not know what to do. Just asking users here on this forum, that’s all.

yeah, I dont think the courts will see it that way. it’s a “breach of contract” to accept an engagement ring and not get married. If it was just a plain gift, yes, you are right. But if it was offered in exchange for the promise of marriage, I’m pretty sure the small claims court will see it his way. But the addition of the last posts from @yinyang make it appear she is willing to give the ring back anyway. So this all appears moot.

Why would she buy what she already has?

That is a good point. Morally, that would be wrong. Could she continue on like that?

Yeah, she could afford to choose her own ring and buy it if she wanted to.

That’s very selfish for a woman to say that.

You think that should influence her because it works in your favor. She might see it another way entirely.

Sorry it’s my opinion. if you gave her the ring, it’s a gift to her and she can do whatever she wants with it. I mean if I gave gifts (like Christmas gifts ) to people I don’t expect them back if we stop talking.

Men and women see things totally different in certain circumstances yet the same with other situations.

I dont know about Canada law, but like I said, in the US, engagement rings are different than a normal gift. There is a promise that comes with accepting an engagement ring. Legally she would have to give it back in the US.

NOt arguing whats right or wrong here, just expressing what legally will happen if he tries to get it back.

I’m not just pulling this out of my rear end. I have heard of cases like this before and after I posted, I looked it up to make sure I wasnt wrong.

I agree that ideally if I give someone something in contract or trade for something then they should refund or return if that something is not delivered.

But engagement ring is not a contract really. You give it to her in good faith that she loves you… it’s all on you I think.

@SzSupportAdmin im not looking at it from a legal perspective .. you might be right… im just saying I don’t feel its right to ask for things back like that. I don’t agree she’s keeping it for whatever reason … and think she should give it back as if it was me id do that. but she’s made her choice.

It is a legal contract. I just looked it up.

ok. sure thing. Im not really interested in arguing that point. Just telling what I know about the law

That’s surprising to me, because what is the object of the contract her body? Anyway.. you have a civil/tort law case if its a contract.

A ring is a part of a marriage contract. It’s legally binding. I guess with the 50% divorce rate, it’s to reduce the man loses but also benefits women as well.
